Topaguide provides booking services (Booking Services) allowing the User to book a selected ride with a Driver (Transport Service) and to pay to the Driver for the Transport Service. The Transport Service is provided directly by a Driver who accepts the booking by the User, as an independent service provider. Topaguide does not provide any Transport Services.
BOOKING: Users make an indicative booking of the Transport Services through the Site by selecting the place of departure, destination and date and time of the departure. If available, the User may also select the places on the route where the Driver will make a pause during the trip. Subject to availability of a Driver Topaguide emails to the User the summary of the booking including the final price for the Transport Service and asks the User to confirm the booking (Booking Confirmation). Following the Booking Confirmation by the User, the User must pay the fee for the Transport Service via a payment service provider based on the instruction received from Topaguide, unless the User and Topaguide agreed that the User shall pay in cash to the Driver. If the User does not pay for the Transport Service within the deadline stipulated in the Booking Confirmation (but always before the confirmed time of departure), Topaguide is allowed to cancel the booking by an email sent to the User. The User is allowed to cancel the Transport Service by an email sent to Topaguide at least 96 hours before the confirmed time of departure with a full refund. The User is not entitled to any refund if he or she cancels the Transport Service less than 48 hours before the confirmed time of departure and/or if he or she does not use the Transport Service (unless the Transport Service was not available due to the fault of the Driver or of Topaguide or unless required by applicable mandatory law).
TRANSPORT: The Driver or Topaguide on behalf of the Driver shall contact the User to agree the detailed pick-up place of departure (e.g. the detailed address within the selected city) well in advance before the confirmed time of departure. The User concludes the agreement on Transport Service with the Driver upon the later of (i) Booking Confirmation and (ii) Topaguide informing the User about the Driver’s name. Topaguide is not a party to such agreement. Topaguide only represents the Driver in communication with the User about the Transport Service. The Driver provides the Transportation Services as an irregular transport service between various European destinations based on the prior booking by the User. The Driver may provide also other services ancillary to the Transport Services (such as providing the User with basic information about the places visited during the trip). The Driver does not provide any additional services unrelated to the Transport Services. Neither Topaguide nor the Driver provide travel agency services.
Cancellation for no-show: Users must be at the agreed pick-up place at the agreed pick-up time. If the User does not appear within 30 minutes after the agreed time, the Driver may cancel the Transport Service without any claim for refund by the User by leaving the agreed pick-up place. If the Driver does not appear within 30 minutes after the agreed time, the User shall call Topaguide to notify the delay. If Topaguide does not arrange a Driver within an additional 30 minutes, the User may cancel the Transport Service by a call to Topaguide informing them about the cancellation. In such case Topaguide will arrange that the Driver will refund the User the full paid price for such cancelled Transport Service within 14 days from the cancellation.
Rules of Conduct: Users must act reasonably and with good manners during the trip to not interfere with the driving. Users must take reasonable care not to damage or dirty the car. Drivers must act reasonably and with courtesy during the trip. While Drivers shall undertake their best effort to arrive at the destination at the estimated time, neither the Driver nor Topaguide makes any warranty to Users about the time of arrival at the destination. Topaguide shall not be liable for any loss or damage arising as a result of the Transportation Service. The Driver’s liability for any loss or damage arising as a result of the Transportation Service shall be limited to the amount of the fees paid by the User for the Transportation Services.
USE OF THE SITE: A User must not change any part of the Site without the prior written consent of Topaguide with all rights are reserved in relation to any registered and unregistered trademarks, copyright protected work or other intellectual property which appear on the Site.
The Site or any portion of the Site may not be reproduced or otherwise exploited for any commercial purpose without the prior written consent of Topaguide. No person is entitled to systematically extract any part of the contents of the Site without the prior written consent of Topaguide. The Site is intended solely for persons who are 18 or older. Any access to or use of the Site anyone under 18 is expressly prohibited. By accessing or using the Site the User represent and warrant that you are 18 or older.

Identification and contacts: The Site as a point of sale of the Transport Services is operated by Topaguide (Topalife spol. S.r.o., st. Domazlicka 1, Prague, Czech Republic) tel. +420777455611 email: email@example.com.
Fees: Drivers provide their Transport Service to Users for fees stated in the Booking Confirmation which is based on the price stated on the Site for the indicative booking made by the User adjusted for any additional changes to the trip agreed by the User. The payment is processed in a currency stated in the Booking Confirmation. Topaguide provides the Booking Services to the Users free of charge. The Drivers are not VAT payers.
Mandatory cancellation right: Any User using the Site as a consumer for a private use may cancel the booking and the agreement on the Transport Service within 14 days from the Booking Confirmation by email sent to firstname.lastname@example.org. This does not apply if the User instructs the Driver to provide the Transport Service already within that 14-days period. The Driver starts to provide the Transport Services already 24 hours before the agreed start of the trip by preparing of the car for the trip (if the period between the Booking Confirmation and the agreed start of the trip is shorter, Driver starts to provide the Transport Services already from the Booking Confirmation). If such start of the Transport Services falls within the 14-days cancellation period, the User expressly instructs the Driver by the virtue of the Booking Confirmation to provide the service before the expiry of the cancellation period and acknowledges that such User is no longer allowed to cancel the Transport Services. In no circumstances may the User cancel the Transport Service less than 24 hours before he agreed start of the trip. If User rightfully cancels the Transport Service, the Driver will refund the User the full paid price for such cancelled Transport Service within 14 days from the cancellation. In such a case Topaguide will arrange that the Driver will refund the User the full paid price for such cancelled Transport Service within 14 days from the cancellation.
By providing your name, contact details and any other personal data (Data) to Topaguide or to a Driver via the Site or otherwise, you give your voluntary consent to Topaguide and to the Driver to use your Data to:
- perform Booking Services as agreed between you and Topaguide and Transport Services as agreed between you and the Driver;
- pursue any action as might be reasonable for Topaguide or Driver to protect their rights; and
- to offer you any services provided by Topaguide or Drivers or other Topaguide's business partners.
Even after you withdraw your consent, Topaguide and the Driver will be allowed to use the Data to perform their agreements with you and for other purposes as might be allowed by applicable laws on personal data protection.
You acknowledge that you have certain rights under the applicable regulations on personal data protection. In particular, you may ask Topaguide and the Driver to provide you with information about processing of your Data and you may request Topaguide and the Driver to explain and remedy any inappropriate processing.
